Capability Management, Inc. is committed to protecting the privacy of the personally-identifiable information that is collected from use of its software application (the “InsightPulse”). The scope of Capability Management’s commitment is detailed in this Privacy Policy. By submitting information, you agree to Capability Management’s collection, storage, use and disclosure of such information as described herein. Please see Capability Management’s Terms of Use for more information about Capability Management’s on-line policies in general.
Collection of personally-identifiable information Capability Management collects personally-identifiable information (“Personal Info”) on certain areas of the InsightPulse when users register. The personally-identifiable information collected may include, without limitation, contact information (name, e-mail addresses, and company name) and geographic location.
Use of Personal Information Capability Management uses your Personal Info to distribute software information and updates, to fulfill your requests for information and to review and consider any inquiries that you may submit. We may keep any of your Personal Info on file and use it to contact you, however, such contact will be limited to e-mail. Except as otherwise provided in this Privacy Policy or the Terms of Use, Capability Management will never share, rent, sell or disclose your Personal Info to any third parties without prior express permission from you as detailed below.
Payment Information Capability Management does not retain your payment card details. We use them solely to process orders through our payment gateway, Stripe.com. Stripe securely stores your payment information to facilitate the payment process.
Disclosure of Personal Information Capability Management will not intentionally disclose (and will take commercially reasonable steps to prevent the accidental disclosure of) your Personal Info to third parties (i.e., persons or entities that are not affiliates of Capability Management), whether for such third parties’ marketing purposes or otherwise, subject only to the following four (4) exceptions:
1. Capability Management may disclose your Personal Info to third parties as required or permitted by the laws, rules and regulations of any nation, state or other applicable jurisdiction;
2. Capability Management may disclose your Personal Info to third parties who deliver information from us to you for the purpose of performing such delivery;
3. Capability Management may disclose your Personal Info if, in connection with submitting the information, you consent to such disclosure; and
4. Capability Management may disclose contact information for you in response to inquiries by bona-fide rights owners in connection with allegations of infringement of copyright, trademark or other proprietary rights arising from information you have posted on the InsightPulse or otherwise provided to Capability Management.
The categories of third parties we may share personal information with are as follows:
- Cloud computing services
- Website infrastructure providers
- Data storage service providers
- Data analytics services
- Verification service providers
- Finance and accounting tools
- Conference and event organisers
We also may need to share your personal information in the following situations:
Business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honour this privacy notice. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
Links to third-party sites and apps Capability Management may provide links to third-party Web sites as a service to our users. However, some of the content appearing to be on the InsightPulse is in fact supplied by third parties. We cannot control and are not responsible for the information collection and privacy practices of such third-party Web sites and/or apps, which may differ from those of the InsightPulse.
Accessing, changing and/or deleting information You may access, correct, update, and/or delete any Personal Info that you have submitted to the InsightPulse. To do so, please either follow the instructions on the page of the InsightPulse on which you have provided such information, or send us an e-mail at info@insightpulse.ai . While Personal Info may be changed or deleted, of a user’s mobile device and home computer are critical to the functionality of the InsightPulse. As such, deletion or restriction of this Personal Info will significantly inhibit a user’s experience.
Security Capability Management has implemented generally accepted standards of technology and operational security in order to protect Personal Info from loss, misuse, alteration, or destruction. Only authorized Capability Management personnel are provided access to Personal Info, and these personnel are required to treat this information as confidential. Despite these precautions, Capability Management cannot guarantee that unauthorized persons will not obtain access to your Personal Info.
Children’s on-line privacy protection Capability Management understands the importance of protecting children’s privacy, especially in an on-line, mobile environment. The InsightPulse is not intentionally designed for or directed at children 17 years of age or younger, and Capability Management will not intentionally collect or maintain information about anyone under the age of 18. Children under the age of 18 should not use the InsightPulse at any time. In the event that we learn of the inadvertent gathering of personal information from children under the age of 18, we will take reasonable measures to promptly erase such information from our records.
Transborder hosting and transfer of information By the very nature of the internet information collected on the InsightPulse, internet information may be transferred from time to time throughout the world, including domain or hosting servers and routers located outside the European Economic Area (EEA), and the InsightPulse may be viewed and hosted anywhere in the world, including countries that may not have laws regulating the use and transfer of personally-identifiable data. By using the InsightPulse and submitting such information on it, you voluntarily consent to such transborder transfer and hosting of such information.
Amendment Capability Management, in its sole discretion, may modify or amend this Privacy Policy at any time. In the event of such modification or amendment, we will notify you by placing a notice on the InsightPulse or by sending you a notice to the email address you have provided.
Consent By using the InsightPulse, you consent to the collection, use, and storage of your information by us in the manner described in this Privacy Policy. Such information will include, but is not limited to, continuously maintaining the geographic location of both your home computer and mobile device. We reserve the right to make changes to this Privacy Policy from time to time. We will alert you to any such changes by updating this Privacy Policy.
